We are very pleased for our client who received a positive
decision in his application or his elderly dependent parents to join him in the
State. A UK national, our client has been working in the State for a
number of years. He was able to provide evidence to show that both
parents in India were dependent on him. Such applications have
always proven difficult to make and the majority of clients come to us to
challenge negative decisions they receive on their applications for family
members to join them where they must show proof of dependency. It is
worth noting that the ECJ has determined that dependency includes both
financial and emotional dependency and accordingly supporting documentation and
evidence to document both types of dependency should be considered.
